These Terms of Service (“Terms”) govern your access to and use of the website at cascadeflow.ai, cascadeflow Studio, and related services (the “Services”) provided by Lemony Inc. (“Lemony”, “we”, “us”, or “our”). Please read them carefully. By accessing or using the Services, you agree to be bound by these Terms.

The open-source project

The cascadeflow open-source core is licensed separately under the MIT License, available in its GitHub repository. Your use of that code is governed by the MIT License, not by these Terms. These Terms govern the website and the hosted cascadeflow Studio service.

Eligibility and accounts

You must be able to form a binding contract to use the Services. If you create a cascadeflow Studio account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorized use.

Acceptable use

You agree not to:

  • use the Services in violation of any applicable law or regulation;
  • interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems;
  • reverse engineer, resell, or misuse the hosted Services except as expressly permitted;
  • upload malicious code or use the Services to transmit unlawful, infringing, or harmful content; or
  • use the Services in a way that infringes the rights of others.

Intellectual property

Except for the open-source components under their own licenses, the Services and all related content, trademarks, and software are owned by Lemony Inc. or its licensors and are protected by intellectual property laws. These Terms do not grant you any right to use the “cascadeflow” or “Lemony” names or logos without our prior written permission.

Your content

You retain ownership of any data or content you submit to the Services. You grant us a limited license to process that content solely to provide the Services to you. You are responsible for ensuring you have the rights to any content you submit.

Third-party services

The Services may integrate with or link to third-party services (such as model providers and infrastructure). We are not responsible for third-party services, and your use of them is governed by their own terms.

Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or that any cost, latency, or quality results will be achieved in your environment.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEMONY INC. AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM.

Indemnification

You agree to indemnify and hold Lemony Inc. harmless from any claims, damages, or expenses arising out of your use of the Services or your violation of these Terms.

Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.

Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in New York, New York.

Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with a new “Last updated” date. Continued use of the Services after changes take effect constitutes acceptance.
